Sapphire Sleep’s 10-YEAR WARRANTY (NON-PRORATED) for 8”, 10” and 12” memory foam & Innerspring Mattresses

Sapphire Sleep products are warrantied against structural defects (excluding ticking cover). For zippered mattress covers refer to the All-Foam Mattress section within the Warranty Coverage Detail section. If you observe a defect, contact the Sapphire Sleep dealer from which you purchased the set. If the dealer cannot be reached, please contact Sapphire Sleep Customer Support here. In either case, you must, within the duration of the warranty, provide the necessary photos of the mattress and/or foundation(s) and proof of purchase (including date of purchase), and be the original purchasing consumer/user.

If defective in workmanship or material, your Sapphire Sleep mattress and/or foundation will be repaired or replaced (at our option) with charges, as shown on the Sapphire Sleep Warranty Schedule and exclusive of transportation and inspection costs. If the Sapphire Sleep product you purchased is discontinued at the time of repair or replacement, a current model of comparable quality and value will be selected. All other claims including incidental or consequential damages are precluded. If identical materials are not available at the time of repair or replacement, the manufacturer reserves the right to substitute materials of  comparable quality. There is no guarantee that the product you receive will have the same fabric cover or construction as your current mattress or foundation, especially if the  replacement is being made several years after the original purchase. Any and all implied warranties on this product shall not exceed in duration the term of this limited warranty.  This warranty begins on the day you purchase your sleep set. If your sleep set is repaired or replaced, this limited warranty will not be renewed or extended. Please refer to the Sapphire Sleep Warranty Schedule below and the code printed on your law label to determine the length of your warranty.

This warranty will apply only if the mattress and/or foundation(s) are NOT abused, misused, or unsanitary. Stains or liquids exposed to the product cause defects, which is why a protective mattress cover is suggested. All rips, stains or tears will void the warranty.

Some states do not allow the exclusion or limitation of incidental or consequential damages or limitations on how long an implied warranty lasts, so the above limitation or exclusion may not apply. This warranty gives you specific legal rights. You may also have other rights, which vary from state to state.

The Sapphire Sleep Warranty covers only the following items during normal wear:

INNERSPRING OR HYBRID MATTRESSES

      • Wires that are loose, broken, or protruding through fabric.
      • Body impressions that measure 1 1/2″ or greater. These are covered only if the mattress has been continuously supported by a matching foundation (or equivalent) and used with an appropriate frame with center support or a minimum of 5 cross slats with center  support that extends to the floor. A Sapphire Sleep adjustable base may be used with an  adjustable-compatible mattress.

ALL FOAM MATTRESSES

      • Body impressions that measure 1 1/2″ or greater. These are covered only if the mattress has been continuously supported by a matching foundation (or equivalent) and used with an appropriate frame with center support or a minimum of 5 cross slats with center support that extends to the floor. A Sapphire Sleep adjustable base may be used with an adjustable-compatible mattress.
      • Zippered mattress covers. These are warrantied for ten years after the purchase date from manufacturing defects and workmanship, flaws of the zipper or seams, and tearing of the fabric under normal use. Zippered covers should never be removed. See label on zippered cover for cleaning suggestions.

SMOOTH TOP (NON-QUILTED) HYBRID MATTRESSES

      • Wires that are loose, broken, or protruding through fabric.
      • Body impressions that measure 1 1/2″ or greater. These are covered only if the mattress has been continuously supported by a matching foundation (or equivalent) and used with an appropriate frame with center support or a minimum of 5 cross slats with center support that extends to the floor. A Sapphire Sleep adjustable base may be used with an adjustable-compatible mattress.

FOUNDATIONS – Not including Adjustable Bases 

      • Broken or loose support elements.
      • Splitting of the wood frame.
      • Broken or loose grid top.
      • Compression or unstapling of support elements.
      • Loose, bent or defective wood beams.
      • Sagging. This is covered only if the foundation has been continuously supported with an appropriate frame with a rigid center support that extends to the floor.

The Sapphire Sleep Warranty does NOT cover items not expressly listed in the “Warranty Coverage” section such as but not limited to:

      • Transportation and inspection costs.
      • Bedding sold “as is”, floor samples, or bedding purchased from second hand parties, non-retail establishments or received as a promotional item.
      • Bedding height.
      • Comfort preference.
      • Bent perimeter border rods due to moving or bending the sleep set for innerspring models.
      • Replacement of another piece in a sleep set, unless it is also defective. • Damage of the mattress or foundation due to misuse or abuse.
      • Mattress damage due to an inappropriate foundation or when an incorrect bed frame is used.
      • Sheet fit.
      • Fabric stains, soiling, fluid penetration, tears or burns.
      • Adjustable foundations.
      • Mattress fabric (except as noted in the Warranty Coverage Detail section for an All-Foam mattress).
      • Zippered mattress cover damage due to improper care, including removal of cover. • Normal change in softness and recovery time associated with memory foam and latex materials over time. This does not affect the pressure relieving qualities of these materials. • Body impressions in the mattress that measure less than 1 1/2″ for an innerspring mattress, and less than 1 1/2″ for all smooth top (non-quilted) hybrid mattresses and All Foam model mattresses.
      • Sagging in the mattress that measures less than 1 1/2″ for an innerspring mattress, and less than 1 1/2″” for all smooth top (non-quilted) hybrid mattresses and All Foam model mattresses.

IMPORTANT INFORMATION

Sapphire Sleep reserves the right to refuse service and invalidate the warranty when the sleep set, even if defective, is in an unsanitary condition (due to blood or bodily fluid stains or soiling, infestation or other abuse), when the sleep set has evidence of damage from liquid penetration, cleaning or the use of cleaning fluids, or whenever the product failure is caused by factors other than defective workmanship or materials.

Allowing the sleep set to be in an unsanitary condition may damage the product and invalidate the warranty. For the health and safety of anyone who would be required to dispose of, or otherwise handle, the sleep set, Sapphire Sleep may refuse to inspect such products to assess whether covered by the warranty, in which case, Sapphire Sleep reserves the right to deny warranty coverage.

The use of cleaning fluids may damage the fabric and materials in your mattress. Allowing water or other liquids to penetrate your mattress may damage the layers of upholstery, causing materials to compress. Either of these situations may result in damage that will invalidate your warranty.

Sapphire Sleep reserves the right to deny warranty coverage if the sleep set exhibits stain(s) or soiling of unknown origin or nature and it appears to Sapphire Sleep, in good faith, that the sleep set may be in an unsanitary condition or may have been damaged by liquid penetration or other abuse.

Sapphire Sleep’s 20-Year Warranty for Visco Memory Mattresses

20 Year Warranty Applies to the Cool-Phase Hybrid, Cool-Phase, Silver and Copper Mattresses

Sapphire Sleep Industries Warrants your mattress, for a period of twenty (20) years from the date of purchase — ten (10) years full warranty, ten (10) years pro-rated— against defects in workmanship and materials. During the initial ten (10) year warranty period, if the product is deemed to be defective, our responsibility for the defective product is limited to repair or replacement as stated below. In addition to the pro-rated charges to replace the mattress, all transportation costs are the responsibility of the purchaser during the entire warranty period. Your mattress will be replaced or repaired, at our option, should it be found defective because of faulty workmanship or structural defects subject to specific limitations contained herein. It is understood that this does not include normal increase of softness in the foam which can occur during normal breaking in, or in the case of visco-elastic memory foam, a lessening of the gradual recovery aspect of the foam, of which such lessening, should it occur, does not reduce the continual pressure reducing and pressure relief properties of the mattress.

Substitution or use of improper foundations, platforms or other bases upon which the mattress is placed, may result in damage to the product. Should an improper base be utilized by the consumer, causing the product to default, the warranty may be voided. It is incumbent on the consumer to maintain the foundation and provide appropriate support for the mattress. We recommend the purchase of a foundation at the time of mattress purchase. Warranty does not include any deterioration of the foam, with an indentation of less than 1.5 inches, not associated with a sag in the foundation, box spring, platform or frame. If such a defect appears during the twenty (20) years of this warranty, we will, at our option, either repair or replace the mattress at a handling cost to be paid by the purchaser. This warranty does not include handles, as handles are to be used only for adjustment purposes and are not intended to be used to lift, turn or transport the product. If a model has been discontinued we will replace it with a mattress of equal or better value at our option. The zippered cover on the mattress is warranted for two (2) years from the date of purchase for defects in material or workmanship. This warranty is void if the product is found to have been tampered with or misused by the purchaser beyond reasonable wear, and shall not apply if the product has been physically damaged intentionally or due to accident and/or neglect; including burns, cuts, water damage, mold, stains, or is otherwise abnormally soiled or unsanitary. Do not use a heating pad or electric blanket with this mattress as it will void this warranty. It is recommended that the consumer protects the mattress with a stain resistant mattress protector.

This warranty is valid only to the original purchaser of the product as indicated on the original sales invoice and it does not extend to any subsequent owner or other transferee of the product. The law tag must not be removed from original product as this identifies the product. The original invoice is required and is the only acceptable proof of purchase. This warranty gives you specific legal rights and you may also have other rights that vary from state to state. In order to provide the optimum sleeping surface this premium product contains only the finest quality materials. As with all premium sleep products certain body conformity adaptations will take place as your mattress adapts to your particular body shape and type and any peculiarities in your spinal alignment or bone structure. This is to be expected and is part of the performance of your mattress. Our representative or designated agent shall make the final determination regarding repair or replacement. We do not warrant our product as a remedy for any specific medical condition and do not warrant against any complications resulting from the use or inability to use this product. We do not warrant individual comfort preferences, sheet fit or height issues resulting from the purchaser’s bed frame size or headboard style. Should this warranty be exercised and your product replaced and/or repaired, the duration of the warranty will not be extended or restarted.

WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

WARRANTY CLAIMS PROCEDURE:

Should a warranty claim arise, the original purchaser shall contact Sapphire Sleep for a Warranty Claim Form and Instructions. The original purchaser shall complete the Warranty Claim Form, clearly detailing the defect, and email it along with a copy of the original sales receipt for the Product to custservice@sapphiresleepindustries.com​ or as otherwise directed on the Warranty Claim Form. Warranty Claim Forms that are incomplete or sent without a copy of the original sales receipt will not be processed and will be returned. Upon receipt by Sapphire Sleep of the completed Warranty Claim Form and the original sales receipt, Sapphire Sleep’ quality control department will verify the defect and/or the applicability of this Limited Warranty thereto. In the event that this Limited Warranty is applicable, a replacement product of equal or greater value will be sent to the customer. The original purchaser will be responsible for shipping, handling, and processing fees. No monetary refunds and/or credits will be issued. Please retain this warranty and your original invoice for twenty (20) years.
